The Trial Penalty

In 2016, 97.3% of defendants in the federal criminal justice system conceded guilt. This means that less than 3% of defendants exercised their constitutional right to trial. The vast majority of a criminal defense attorney's time is dedicated to plea bargaining - we negotiate with prosecutors to reach an acceptable outcome for clients. Plea negotiations are an important tool for defendants. However, when a defendant wishes to go to trial, is he or she punished for doing so?

Narcotics and Drugs: The Opioid Crisis

Opioid Crisis.jpgPoliticians speak frequently about Narcotics and Drugs. Recently, the Trump administration rolled out a plan to combat the opioid crisis, which includes increased funding for Medicaid recipients struggling with addiction and testing for opioids in prisons to direct people towards treatment centers. Also among these measures is a plan to subject some drug cases to the death penalty. No matter where one stands on these efforts, the first question should be: how effective will these measures be?

Protecting Your Rights - Client Satisfaction

What should you consider when hiring a Michigan criminal defense attorney in Detroit or the suburbs for protecting your rights?  The following are some of the factors: years of experience, former employment, professional memberships, academic success, standing in the legal community, and client satisfaction.

Police & You: Is Your Smart Phone Data Protected?

Expect new developments this year regarding the Police & You.  On Friday, January 17, the U.S. Supreme Court agreed to hear two cases regarding the authority of police to search the contents of an individual's cell phone without a warrant. The Court has agreed to review Riley v. California and United States v. Wurie. Both cases involve information found in the defendant's cell phone that was used as evidence to convict.

White Collar Crime Includes Election Fraud

Notwithstanding the fact that White Collar Crime includes election fraud, Michigan Attorney General Bill Schuette has stated it is unlikely that fromer Rep. Thaddeus McCotter will face criminal charges after it was discovered that four of his former staff members allegedly faked ballot petition signatures. Unfortunately for the staffers, they are not quite as lucky. Attorney General Schuette apparently did not have enough evidence to link McCotter to the fraud scheme, but his four staffers are currently being accused of crimes including forgery and conspiracy. All four currently have pending criminal charges against them in several different courts.

Police & You: GPS Means Big Brother is Watching

Technology is changing the relationship between the police & you.  As mobile devices become more advanced, so do the ways police can track you. Recently, the Sixth Circuit Federal Court of Appeals ruled that law enforcement officials can use cell phone data, specifically GPS information, to track and locate people without a warrant.

Who Killed Jane Bashara? Violent Crime in the Burbs

The ongoing violent crime saga of who killed Jane Bashara, the deceased wife of Bob Bashara, took a very strange turn yesterday. Authorities say they have Bob Bashara on tape offering $2,000 to a hit man to kill Joseph Gentz, the man Bob Bashara allegedly hired to kill Jane Bashara. Wayne County Prosecutor Kym Worthy stated that Bashara had numerous meetings with several different individuals between June 8 and June 25 regarding killing Gentz as he waits in jail before his trial on July 23. Bashara is expected to be arraigned today in 36th District Court in Detroit. Worthy stated in a press conference earlier today that Bashara was being charged with one count of solicitation to murder.
